Software licence Agreement
THIS VERSION OF THE
LICENSE AGREEMENT IS ONLY A SERVICE FOR YOU. IF THERE
IS ANY DIFFERENCE BETWEEN THE ENGLISH VERSION AND THE
GERMAN VERSION, THE GERMAN VERION IS CORRECT AND YOU
AGREE TO THE GERMAN VERION (YOU CAN FIND THE GERMAN
VERSION UNDER THE ENGLISH VERSION)
This is a legal agreement between you and Michel
Honold, covering your use of a RapidWeaver Theme made
by Michel Honold (the "Software"). Be sure to read the
following agreement before using the Software.
BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY
THE TERMS OF THIS AGREEMENT IN GERMAN (YOU CAN FIND THE
GERMAN VERSION UNDER THE ENGLISH VERSION). IF YOU DO
NOT AGREE TO THE TERMS OF THIS AGREEMENT IN GERMAN (YOU
CAN FIND THE GERMAN VERSION UNDER THE ENGLISH VERSION),
DO NOT USE THE SOFTWARE AND DESTROY ALL COPIES IN YOUR
POSSESSION.
The Software is owned by Michel Honold and is protected
by German copyright laws and international treaty
provisions. Therefore, you must treat the Software like
any other copyrighted material (e.g., a book or music
record).
Paying the licence fee allows you the right to use the
Software on your PCs or Macintoshs (You ave to own the
PCs or Macintoshs) and any website you made. A website
shall be defined as any text, image and binary data
retrieval service operating on a computer, accessible
at a single internet domain name, by means of a remote
computer, over a public network, using the hypertext
transport protocol over TCP/IP.
You may install the Software on behalf of a third party
subject to their agreeing to be bound by the terms of
this licence but you may not re-distribute, sell, rent
or lease the Software to others. You may make
modifications to the software but the original licence
agreement will remain in force for the modified
version. If you use the modefied version of the
Software for creating websites for other people then
yourself and earn money for that, you have to inform
Michel Honold and pay a Licence that costs 10 € (In
words: ten euro). If you violate any part of this
agreement, your right to use this Software terminates
automatically and you must then destroy all copies of
the Software in your possession.
The Software and its related documentation are provided
"AS IS" and without warranty of any kind and Michel
Honold expressly disclaims all other warranties,
expressed or implied, including, but not limited to,
the implied warranties of merchantability and fitness
for a particular purpose. Under no circumstances shall
Michel Honold be liable for any incidental, special, or
consequential damages that result from the use or
inablility to use the Software or related
documentation, even if Michel Honold has been advised
of the possibility of such damages. In no event shall
Michel Honold's liability exceed the licence fee paid,
if any.
This Agreement shall be governed by the laws of
Germany. If for any reason a court of competent
jurisdiction finds any provision of the Agreement, or
portion thereof, to be unenforceable, that provision of
the Agreement shall be enforced to the maximum extent
permissible so as to effect the intent of the parties,
and the remainder of this Agreement shall continue in
full force and effect.
The Software and documentation is provided with
RESTRICTED RIGHTS as described in the Licence
Agreement.

Software Lizenz Vereinbarung
Dies ist eine
Rechtsvereinbarung zwichen Ihnen und Michel Honold,
betreffend Ihre Nutzung der von Michel Honold
erstellten RapidWeaver Themes (die "Software"). Lesen
Sie dieses Vereinbarung Sie die Software nutzen.
MIT DER NUTZUNG DER SOFTWARE STIMMEN SIE DEN
BEDINGUNGEN, DIE IN DIESER SOFTWARE LIZENZ VEREINBARUNG
DARGESTELLT SIND ZU. WENN SIE DIESER VEREINBARUNG NICHT
ZUSTIMMEN, DÜRFEN SIE DIESE SOFTWARE NICHT NUTZEN UND
MÜSSEN ALLE KOPIEN DER SOFTWARE IN IHREM BESITZ
VERNICHTEN.
Die Software ist Eigentum von Michel Honold und durch
das Deutsche Urheberrechtsgesetz und seine
Internationalen Übereinstimmungen geschützt.
Durch den Erwerb der Lizenz erhalten Sie die Erlaubnis
die Software auf allen PCs oder Macintoshs in Ihrem
Besitz sowie auf allen Websites die Sie für sich oder
andere erstellen zu nutzen. Eine Website ist definiert
als Text, Bilder und Binäre Daten und Operationen auf
Computern, die über eine Internetdomain (SLD) unter der
Nutzung des Hypertext transport protocol über TCP/IP
angesprochen werden kann.
Sie dürfen die Software nutzen um Websites für Dritte
zu erstellen, wie es diese Lizenzvereinbarung
gestattet. Es ist nicht erlaubt, die Software zu
vermieten, zu verkaufen, weiter zuvertreiben, zu
duplizieren oder an andere weitergeben. Wenn Sie
Veränderungen an der Software vornehmen ändert dies
nicht den Inhalt und die Bedingungen dieser Lizenz
Vereinbarung. Sollten Sie die veränderte Version der
Software Nutzen, um Websites für Dritte zu erstellen,
müssen Sie eine Lizenzgebühr von 10€ (In Worten: Zehn
Euro) an Michel Honold zahlen.
Sie stimmen zu auf jegliche Entschädigung und Haftung
durch Michel Honold zu verzichten, für jegliche
Schäden, die durch die Software, die Nutzung der
Software, Inkompatibilität der Software mit Software
von Michel Honold, Inkompatibilität der Software mit
Software von Dritten sowie alles andere entstehen, was
mit der Software in Zusammenhang steht. In keinem der
genannten und in allen nicht genannten Schadensfällen
haftet Michel Honold nicht und zahlt keine
Entschädigungen für jegliche Art von Schäden und
Verlusten Finanzieller, Ideeller oder anderer Art.
Diese Vereinbarung entspricht den Gesetzen
Deutschlands. Sollten einzelne Bestimmungen nach
deutschem Recht ungültig sein, bleibt der Rest der
Vereinbarung davon unberührt und behält seine
Gültigkeit.
Die Software und Dokumentation sind unter
Beschränkungen freigegeben wie in dieser Lizenz
Vereinbarung beschrieben.
